1. Acceptance of Terms

By using Introspectly, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please refrain from using our Service.

2. Description of the Service

Introspectly is a self-reflection and journaling app that provides the following core functionalities:

  • Journal Management:
    • Creation, Editing, and Viewing: Users can create new journal entries, edit entries from today or the previous day, and view current entries within the app.
    • History Access: Full access to the archive of your past journal entries.
  • AI-Generated Insights, Analytics, and Guided Journaling Prompts:
    • Based on the content of your journal entries processed by OpenAI, the Service generates insights, analytics, and guided prompts for informational purposes only. To generate such analysis, you must have at least 5 journal entries. The more entries you have, the more accurate and valuable the analysis will be. If there are insufficient journal entries, no AI-generated data will be provided. You may receive up to 15 journaling prompts per day.
    • One-time Generation per Period: For each selected period (e.g., a week or month, as defined by your subscription plan or settings), you may only generate deep introspection, insights, or analytics once. If you have not journaled sufficiently during that period, the system will respond that there is not enough information to create meaningful insights.
    • User Responsibility: It is your responsibility to maintain a sufficient journaling frequency to receive meaningful AI-generated insights. Failure to do so may result in the system not producing any insights.
    • No Partial Refunds: In the event that insufficient journal entries prevent the generation of AI insights, you acknowledge that no partial refunds or credits will be issued for the AI feature during that period.
    • History Access: You can view the complete history of your previously generated insights and analytics.
  • Deep Introspection:
    • Utilizing OpenAI technology, the Service offers a "Deep Introspection" feature that generates detailed analytical data to provide profound insights into your personality and potential. To generate such analysis, you must have at least 5 journal entries. The more entries you have, the more accurate and valuable the analysis will be. If there are insufficient journal entries, no AI-generated data will be provided.
  • Mood Tracking and Emotion Detection:
    • Based on your journal entries processed by OpenAI, Introspectly detects your daily mood (ranging from –10 to 10) and emotion intensity (from 0% to 100%) for personal reflection.
  • Progress Tracking:
    • A "day streak" feature helps you keep track of consecutive days you have journaled.
  • Profile Customization:
    • Users can update profile details such as timezone, language, and username.
  • Additional Features:
    • Personalized content tailored to your profile.

The Service is provided “as is” for your personal, non-commercial use.

3. User Account and Eligibility

  • Account Registration: You must provide accurate and complete information during registration and maintain its accuracy.
  • Age Requirement: You must be at least 16 years old to use the Service. By registering, you confirm that you meet this requirement.

4. Subscriptions, Billing, and Payment

  • Subscription Plans: Introspectly is offered on a subscription basis with options for monthly, quarterly (3-month), or yearly plans.
  • Auto-Renewal: Subscriptions automatically renew at the end of each subscription period.
  • Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current paid period, and you will not be charged for subsequent periods.
  • Refund Policy: All subscription fees are non-refundable except as required by applicable law.
  • Payment Processing: Payments are processed via Stripe, and by subscribing, you agree to Stripe’s terms and conditions.

5. AI-Generated Content Disclaimer

  • Informational Purposes Only: The AI-generated insights, analytics, prompts, and guidance provided by Introspectly are for informational purposes only and should not be considered professional advice.
  • No Professional Relationship: Reliance on AI-generated content is solely at your own risk. We do not guarantee its accuracy or reliability and are not liable for any decisions made based on it.
  • Limitation: Although our AI system is designed to provide helpful insights, it may occasionally produce incorrect or incomplete information. You should not rely solely on these outputs for decisions related to your mental health or other professional matters. Please consult a qualified professional when needed.

6. Mood Tracking and Emotion Detection

The mood tracking and emotion detection features are provided solely for your personal reference. They are not intended to replace professional diagnosis or advice. If you have concerns regarding your mental health, please consult a professional.

7. Intellectual Property Rights

  • Our Property: All content provided by Introspectly, including but not limited to text, graphics, logos, and software, is the property of Introspectly or its licensors and is protected by intellectual property laws.
  • License to Use: We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for personal, non-commercial purposes.
  • Feedback: Any feedback or suggestions you provide become our property, and we may use them without any obligation to you.

8. User Content

  • Ownership: You retain ownership of your journal entries and other content you create.
  • License Grant: By submitting content, you grant Introspectly a worldwide, non-exclusive, royalty-free license to use, store, process, and display your content as necessary to provide the Service.
  • Prohibited Content: You must not upload content that is unlawful, harmful, or infringes on the rights of any third party. You agree not to submit journal entries that include content inciting or promoting self-harm, harm to others, violent content, or sexual content involving minors. Any such content will not be processed for AI-generated insights.

9. User Responsibilities for Account Security

You are responsible for maintaining the security of your authentication credentials. Since Introspectly does not store or manage your passwords, your account security depends on how well you protect your email and authentication provider account.

By using our Service, you agree that:

  • You are responsible for securing your email account, as it is used for authentication and recovery.
  • You should enable two-factor authentication (2FA) on your email and authentication provider accounts to add an extra layer of security.
  • Introspectly is not responsible for unauthorized access to your account due to compromised email credentials, weak passwords, or lack of 2FA.

If you suspect unauthorized access to your account, immediately secure your email and authentication account. For assistance, please contact help@introspectly.com.

10. Lost Access to Your Account

Because Introspectly uses third-party authentication providers (e.g., Google, Discord), we do not store passwords and cannot restore access to your account if you lose access to your email or authentication provider.

If you cannot log in due to a forgotten password or loss of access, you must contact your email or authentication provider directly.

By using our Service, you agree that:

  • Introspectly is not responsible for account recovery if you lose your authentication credentials.
  • If you lose access to your email, you may permanently lose access to your Introspectly account.
  • We strongly recommend enabling two-factor authentication (2FA) on your email and authentication provider accounts to enhance security.

If you suspect unauthorized access, please secure your email immediately and contact help@introspectly.com for assistance.

11. Prohibited Conduct

  • You agree not to use the Service in any manner that violates applicable laws.
  • You agree not to engage in activities that could damage, disable, or impair the Service or interfere with other users' experience.
  • You agree not to upload or distribute viruses, malware, or any harmful code.
  • You agree not to harass, defame, or abuse other users.

We reserve the right to suspend or terminate your account if you violate these Terms.

12. Limitation of Liability

  • Disclaimer: The Service is provided “as is” and “as available” without any express or implied warranties.
  • No Liability: To the maximum extent permitted by law, Introspectly shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Service.
  • User Responsibility: You assume all risks associated with the use of the Service.

13. Indemnification

You agree to indemnify, defend, and hold harmless Introspectly, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Service or your violation of these Terms.

14. Governing Law and Dispute Resolution

  • Governing Law: These Terms shall be governed by the laws of the United Kingdom.
  • Jurisdiction: Any disputes arising under these Terms shall be resolved exclusively in the courts of the United Kingdom.
  • Dispute Resolution: We encourage you to contact us to resolve disputes amicably. If a dispute cannot be resolved informally, it shall be submitted to the appropriate courts in the United Kingdom.

15. Modifications to These Terms

We reserve the right to modify or update these Terms at any time. In the event of material changes:

  • We will notify you via email or through an in-app notification.
  • Your continued use of the Service after the effective date of the changes constitutes acceptance of the updated Terms.

16. Termination

  • By You: You may terminate your account at any time using the account deletion feature in your settings. Upon deletion, all your data will be immediately removed.
  • By Us: We reserve the right to suspend or terminate your access to the Service if you breach these Terms or for any other legally permissible reason.
  • Effect of Termination: Upon termination, your access to the Service will cease; however, any outstanding subscription fees will remain due as described in Section 4.

17. Miscellaneous

  • Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Introspectly regarding your use of the Service.
  • Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.
  • No Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that or any other provision in the future.
